5.3 WhatsApp Business

You have the option of contacting us via the WhatsApp messaging service of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. For this purpose, we use the so-called “Business version” of WhatsApp.

If you contact us via WhatsApp on the occasion of a specific transaction (for example, an order you have placed), we store and use the mobile phone number you use on WhatsApp and – if provided – your first and last name in accordance with Art. 6 (1) (b) GDPR for the purpose of processing and responding to your enquiry. On the same legal basis, we may ask you via WhatsApp to provide additional data (order number, customer number, address or e-mail address) in order to be able to assign your enquiry to a specific transaction.

If you use our WhatsApp contact for general enquiries (for example about our range of services, availability or our online presence), we store and use the mobile phone number you use on WhatsApp and – if provided – your first and last name in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in providing the requested information efficiently and promptly.

Your data will only ever be used to respond to your enquiry via WhatsApp. It will not be passed on to third parties.

Please note that WhatsApp Business has access to the address book of the mobile device we use for this purpose and automatically transmits stored telephone numbers to a server of the parent company Meta Platforms Inc. in the USA. For the operation of our WhatsApp Business account, we use a mobile device whose address book only stores the WhatsApp contact data of those users who have also contacted us via WhatsApp.

This ensures that every person whose WhatsApp contact data is stored in our address book has already consented, when first using the app on their device, by accepting the WhatsApp terms of use, to the transmission of their WhatsApp telephone number from the address books of their chat contacts in accordance with Art. 6 (1) (a) GDPR. The transmission of data of users who do not use WhatsApp and/or have not contacted us via WhatsApp is therefore excluded.

If your contact is aimed at concluding a contract, the additional legal basis for the processing is Art. 6 (1) (b) GDPR. Your data will be deleted when it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

6) Comment function

As part of the comment function on this website, in addition to your comment, information on the time the comment was created and the commentator name you have chosen is stored and published on this website. Your IP address is also logged and stored. This storage of the IP address is for security reasons and in the event that the person concerned violates the rights of third parties or posts unlawful content by submitting a comment. We need your e-mail address in order to contact you if a third party objects to your published content as being unlawful.

The legal bases for storing your data are Art. 6 (1) (b) and (f) GDPR. We reserve the right to delete comments if they are objected to by third parties as being unlawful.

7) Data processing when opening a customer account

In accordance with Art. 6 (1) (b) GDPR, personal data will continue to be collected and processed to the extent necessary if you provide it to us when opening a customer account. You can see which data is required to open an account from the input form on our website.

You can delete your customer account at any time by sending a message to the controller at the address given above. After deletion of your customer account, your data will be deleted provided that all contracts concluded via it have been fully processed, there are no statutory retention periods to the contrary and we have no legitimate interest in continuing to store the data.

8) Use of customer data for direct advertising

8.1 Subscribing to our e-mail newsletter

If you subscribe to our e-mail newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your e-mail address. Providing additional data is voluntary and is used to address you personally. For sending the newsletter, we use the so-called double opt-in procedure, which ensures that you only receive newsletters once you have expressly confirmed your consent to receive the newsletter by clicking on a verification link sent to the specified e-mail address.

By activating the confirmation link, you give us your consent to use your personal data in accordance with Art. 6 (1) (a) GDPR. In this context, we store the IP address entered by your internet service provider (ISP) as well as the date and time of registration in order to be able to trace any possible misuse of your e-mail address at a later time. The data collected by us when you register for the newsletter will be used strictly for the intended purpose.

You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by sending a corresponding message to the controller named at the beginning. After you have unsubscribed, your e-mail address will be deleted from our newsletter distribution list without delay, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this policy.

8.2 Sending the e-mail newsletter to existing customers

If you have provided us with your e-mail address when purchasing goods or services, we reserve the right to regularly send you offers by e-mail for similar goods or services from our range to those you have already purchased. For this we do not need to obtain separate consent from you in accordance with Section 7 (3) UWG (German Act Against Unfair Competition). Subject to your express consent in accordance with Art. 6 (1) (a) GDPR, the provider also carries out a statistical evaluation of the success of newsletter campaigns using web beacons or tracking pixels in the e-mails sent, which can measure open rates and specific interactions with the content of the newsletter. Device information (e.g. time of access, IP address, browser type and operating system) is also collected and evaluated, but not merged with other data sets.

9) Data processing for order handling

9.1 Insofar as it is necessary for contract processing for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 (1) (b) GDPR.

If, on the basis of a corresponding contract, we owe you updates for goods with digital elements or for digital products, we process the contact data you provided when placing the order in order to inform you personally about upcoming updates within the scope of our statutory information obligations in accordance with Art. 6 (1) (c) GDPR. 9.3 Use of payment service providers (payment services)

- Apple Pay

If you choose the “Apple Pay” payment method of Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, payment will be processed via the “Apple Pay” function of your device running iOS, watchOS or macOS by charging a payment card stored with “Apple Pay”. Apple Pay uses security functions that are integrated into the hardware and software of your device to protect your transactions. To approve a payment, you must therefore enter a code that you have previously defined and verify it using the “Face ID” or “Touch ID” function of your device.

For the purpose of payment processing, the information you provide during the ordering process, together with information about your order, is transmitted to Apple in encrypted form. Apple then encrypts this data again with a developer-specific key before transmitting the data to the payment service provider of the payment card stored in Apple Pay for the purpose of carrying out the payment. The encryption ensures that only the website through which the purchase was made can access the payment data. After the payment has been made, Apple sends your device account number and a transaction-specific, dynamic security code to the originating website to confirm the success of the payment.

Apple stores anonymised transaction data, including the approximate purchase amount, the approximate date and time and whether the transaction was successfully completed. Due to anonymisation, a personal reference is completely excluded. Apple uses the anonymised data to improve “Apple Pay” and other Apple products and services.

If you use Apple Pay on your iPhone or Apple Watch to complete a purchase that you made via Safari on your Mac, the Mac and the authorisation device communicate via an encrypted channel on Apple’s servers. Apple does not process or store any of this information in a format that can identify you personally. You can disable the ability to use Apple Pay on your Mac in the settings of your iPhone. Go to “Wallet & Apple Pay” and deactivate “Allow Payments on Mac”.

If you choose the “Google Pay” payment method of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”), payment will be processed via the “Google Pay” application on your mobile device running at least Android 4.4 (“KitKat”) and equipped with an NFC function by charging a payment card stored with Google Pay or a payment system verified there (e.g. PayPal). To approve a payment via Google Pay of more than €25, you must first unlock your mobile device using the verification method set up in each case (e.g. facial recognition, password, fingerprint or pattern).

For the purpose of payment processing, the information you provide during the ordering process, together with information about your order, is transmitted to Google. Google then transmits your payment information stored in Google Pay in the form of a one-time transaction number to the originating website, which is used to verify a successful payment. This transaction number does not contain any information about the actual payment data of your payment methods stored with Google Pay, but is created and transmitted as a one-time valid numeric token. In all transactions via Google Pay, Google only acts as an intermediary for processing the payment. Google reserves the right to collect, store and evaluate certain transaction-specific information for each transaction carried out via Google Pay. This includes the date, time and amount of the transaction, the merchant’s location and description, a description of the goods or services purchased provided by the merchant, photos you attach to the transaction, the name and e-mail address of the seller and buyer or sender and recipient, the payment method used, your description of the reason for the transaction and, where applicable, the offer associated with the transaction.

For the visual design of the CAPTCHA window, “Google Fonts”, i.e. fonts loaded from the internet by Google, are used by the provider. No further information is processed beyond the information already transmitted to Google via the functionality of reCAPTCHA.

The service checks whether an entry is made by a natural person or abusively by automated, machine processing and blocks spam, DDoS attacks and similar automated malicious access. In order to ensure that an action is carried out by a human being and not by an automated bot, the provider collects the IP address of the device used, identification data of the browser and operating system type used and the date and duration of the visit and transmits this information to the provider’s servers for evaluation. Cookies may be used in this process, i.e. small text files that are stored in the browser of the device.

This programme gives us the opportunity to obtain customer reviews from users of our website. You will be asked after a purchase on our website whether you would like to take part in a Google e-mail survey.

If you give your consent in accordance with Art. 6 (1) (a) GDPR, we will transmit your e-mail address to Google. You will receive an e-mail from Google Customer Reviews asking you to rate your purchase experience on our website. The rating you submit will then be combined with our other ratings and displayed in our Google Customer Reviews logo and in our Merchant Center dashboard. Your rating will also be used for Google Seller Ratings. In the context of the use of Google Customer Reviews, personal data may also be transmitted to the servers of Google LLC in the USA.

12.8 ShopSync for Shopify

This website uses the Shopify app “ShopSync” from ShopSync LLC, PO Box 252, Jefferson City, TN 37760, USA.
With the help of ShopSync, the newsletter service “Mailchimp” is synchronised with our Shopify account so that, on the one hand, updates in Mailchimp e-mail lists (such as an opt-out by a newsletter recipient) are automatically stored on Shopify and, on the other hand, new contact data generated via contract conclusions on Shopify is automatically transferred to Mailchimp e-mail lists.

In the first case, data processing is carried out in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in the effective and cross-system maintenance of advertising address files and the efficient observance of legally relevant status changes.

In the second case, exclusively on the basis of the user’s express consent in accordance with Art. 6 (1) (a) GDPR, the user’s first and last name, address and e-mail address, together with transaction-related information (purchase amount, time and date of purchase), are transmitted by ShopSync to Mailchimp after a contract has been concluded on Shopify for inclusion in the Mailchimp list.

Data transmitted in this way is not stored or retained by ShopSync after synchronisation. All information synchronised between Shopify and Mailchimp is transmitted via SSL technology (Secure Socket Layer), and all transmitted information remains encrypted during the synchronisation process.

The synchronisation process requires the transmission of information via a secure connection to servers hosted by Amazon Web Services in the USA.

13) Tools and miscellaneous

13.1 Lexware Office

For our accounting we use the service of the cloud-based accounting software of the following provider: Haufe-Lexware GmbH & Co. KG, Munzinger Straße 9, 79111 Freiburg, Germany

The provider processes incoming and outgoing invoices and, where applicable, the bank transactions of our company in order to automatically record invoices, match them to transactions and create financial accounting from them in a partially automated process.

Insofar as personal data is processed in this context, processing is carried out on the basis of our legitimate interest in the efficient organisation and documentation of our business transactions in accordance with Art. 6 (1) (f) GDPR.

13.2 Cookie consent tool

This website uses a so-called “cookie consent tool” to obtain effective user consent for cookies and cookie-based applications that require consent. The “cookie consent tool” is displayed to users as an interactive user interface when they access the site, where consent can be given for certain cookies and/or cookie-based applications by ticking a box. By using the tool, all cookies/services requiring consent are only loaded if the respective user has given the corresponding consent by ticking the box. This ensures that such cookies are only set on the respective user’s device if consent has been given.

The tool sets technically necessary cookies to store your cookie preferences. Personal user data is generally not processed in this context.

To verify and publish customer reviews, we use the services of the following provider: Judge.me Ltd., c/o Buckworths, 2nd Floor, 1-3 Worship Street, London, England, EC2A 2AB, United Kingdom

If you submit a review on our website, your first and last name, your e-mail address, order date and number as well as the name and international references (GTIN/ISBN) are collected, transmitted to the provider and evaluated there in order to decide on the legitimacy of a customer review for a specific order. This processing is carried out in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in ensuring the authenticity of customer reviews by ensuring that they relate to a transaction and in preventing review abuse. After the review has been checked and approved, the data is deleted by the provider.

For data transfers to the provider’s location, an adequate level of data protection is guaranteed by an adequacy decision of the European Commission.
